Terms

Terms of engagement

The terms that apply to every Deal Check, Full Due Diligence report and Ongoing Partnership.

1. Parties

These terms are between Escave Property Deals Ltd, trading as Escave Group, Company No. 14710973, registered office Bartle House, 9 Oxford Court, Manchester, England, M2 3WQ ("I", "me"), and the client named in the engagement letter ("you").

Each engagement is confirmed in a written engagement letter. If the engagement letter and these terms differ, the engagement letter applies.

2. Scope of each service

  • Deal Check, £495 per deal: Yield, cashflow and return on cash invested; Full acquisition cost breakdown; Stress test on rate and void assumptions; Red flag review of the property and area; Written verdict: proceed, negotiate or walk away.
  • Full Due Diligence, £1,250 per deal: Everything in the Deal Check; Title, tenure and planning history review; Comparable rental and sales evidence; Area, demand and regulatory context; Three layer report with a cited evidence file.
  • Ongoing Partnership, £1,495 per month: Agreed number of Deal Checks and Full DD reports; Priority scheduling ahead of single orders; Direct line to Adrian for deal questions; Monthly scope review.
  • The exact property, scope and fee are set out in the engagement letter.

3. What is excluded

  • Independent property due diligence means analysis of a residential property deal, its numbers, risks and evidence, with a verdict based on my findings.
  • I do not hold, manage or invest client money.
  • The work is not a RICS survey, a structural survey, a valuation or legal work. You should instruct a solicitor and a RICS surveyor before buying.
  • The decision to buy is always yours.
  • This analysis does not constitute investment advice or regulated financial advice. It is not a RICS survey, a structural survey, a valuation or legal advice. It is based on information available at the data date shown. The client makes their own decision and should take independent legal and financial advice, and instruct a RICS surveyor, before committing to a purchase.

4. Your responsibilities

  • Give me accurate and complete information about the deal and tell me promptly if anything changes.
  • Provide the identity documents needed for anti money laundering checks before work starts.
  • Read the report in full, including its limitations and the data date shown.

5. Fees and payment

  • Fees are fixed and shown in full on the services page and in the engagement letter.
  • Single reports are paid in full before work starts. The Ongoing Partnership is paid monthly in advance.
  • No work starts and no payment is taken until the engagement letter is signed.

6. Delivery

Delivery times are targets: 24 hours for a Deal Check and 72 hours for Full Due Diligence, counted from receipt of the signed engagement letter, payment, completed identity checks and the information needed. Partnership work is scheduled ahead of single orders. If I expect to miss a target, I will tell you before it passes. The service is provided with reasonable care and skill.

7. Your right to cancel

  • If you are a consumer and the contract is made at a distance (online, by email or by phone), you have the right to cancel within 14 days of the day the contract is made, without giving a reason.
  • Because a report has a target delivery shorter than 14 days, I will only start within the cancellation period if you expressly ask me to in writing.
  • If you ask me to start and then cancel before the work is complete, you pay a proportionate charge for the work done up to the point you tell me, and the rest is refunded within 14 days.
  • Once the service has been fully performed at your express request, you lose the right to cancel.
  • To cancel, send a clear statement to [email protected]. You may use the model cancellation form below, but you do not have to.

9. Liability

  • [SOLICITOR TO SET liability cap]
  • Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited by law, including your rights under the Consumer Rights Act 2015.
